Terms of Service

1. Who we are

LuminaPlot ("the Service") is provided by UpMix Music Group ApS ("we", "us"), a company registered in Denmark.

2. The Service

LuminaPlot is a web application for designing theatrical and live-event lighting plots, managing fixture inventories, patching DMX addresses, and exporting documentation. We offer a free tier and a paid "Pro" subscription with expanded limits and features.

3. Accounts

You must provide accurate registration details and keep your password secure. You are responsible for activity under your account. You must be at least 16 years old, or the age of digital consent in your country. Notify us promptly of any unauthorised use.

4. Subscriptions, billing and trials

• Pro is billed in advance on a monthly or annual basis through our payment processor, Stripe.
• Paid plans may begin with a free trial. If a trial is offered, your payment method is charged automatically when the trial ends unless you cancel before then.
• Subscriptions renew automatically until cancelled. You may cancel at any time from your account's billing portal; access continues until the end of the paid period.
• Prices are shown exclusive or inclusive of VAT as indicated at checkout; applicable EU VAT is calculated and collected via Stripe Tax.
• We may change prices with at least 30 days' notice for the next billing period.

5. Refunds

Our refund commitments are described in the Refund Policy, which forms part of these Terms.

6. Right of withdrawal (EU consumers)

If you are an EU consumer, you normally have a 14-day right of withdrawal for digital services. By starting to use the Service during that period you may ask us to begin performance immediately and acknowledge that your right of withdrawal is lost once the service is fully performed. See the Refund Policy for how we apply this.

7. Acceptable use

• Don't break the law, infringe others' rights, or upload malicious content.
• Don't attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service.
• Don't resell or redistribute the Service without our written permission.

8. Your content

You retain ownership of the plots, inventories and other data you create ("Your Content"). You grant us a limited licence to store and process Your Content solely to operate the Service. You can export or delete Your Content at any time from your account.

9. Availability and changes

We aim for high availability but do not guarantee uninterrupted service. We may modify or discontinue features; where a change is material and adverse to paying users, we will give reasonable notice.

10. Liability

The Service is provided "as is". To the extent permitted by law, our aggregate liability for any claim is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect or consequential loss. Nothing limits liability that cannot be limited under Danish law.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms. On termination, the right to use the Service ceases; export Your Content beforehand.

12. Governing law

These Terms are governed by the laws of Denmark, and disputes are subject to the courts of Denmark, without prejudice to mandatory consumer protections in your country of residence.
